Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of Nightingual, an educational web application that helps learners practise speaking nursing terminology and abbreviation full forms. By creating an account or using Nightingual, you agree to these Terms.
1. About Nightingual
Nightingual provides learning tools for nursing-related English pronunciation, including General abbreviation practice, specialty vocabulary and topic modules, listen-and-speak lessons, pronunciation assessments, progress badges, tournaments with awards, a referral programme, and in-app feedback chat (including optional browser notifications for replies).
Nightingual is for education and language practice only. It is not a clinical decision-support tool, electronic health record, charting system, or substitute for professional nursing, medical, or legal advice.
2. Eligibility and accounts
You must provide accurate registration information (such as name, email, and password) and keep your login credentials secure. You are responsible for activity under your account. Password reset and optional third-party sign-in may be available when configured by the operator.
Some features identify school affiliation from email domain (for example Saint Francis University school emails). You must not misrepresent your identity, school status, or subscription status.
Each account may receive a permanent member number. Optional nicknames and member numbers may appear on tournament leaderboards. Do not use nicknames that are abusive, misleading, or infringe others’ rights.
3. Free trial, school access, and Nightingual Plus
New non-school consumer accounts may receive a 14-day free trial granted in the app at signup. The trial is not granted again at Stripe Checkout: subscribing starts paid billing under the plan you choose, with no second free period at checkout.
During the 14-day consumer free trial, specialty modules beyond General abbreviations and tournament entry are not included. Subscribe to Nightingual Plus after the trial ends to unlock those privileges. The in-app Subscribe control may remain unavailable until the trial ends.
Eligible SFU nursing students registering with a recognised school email may receive free Plus-level access until an estimated graduation date configured by the service. Free school access ends when that period expires or eligibility ends; continued specialty and tournament access then requires a paid subscription unless another grant applies.
Nightingual Plus is offered as a paid subscription via Stripe Checkout. Current advertised prices include HKD $78 per month and HKD $748 per year (when yearly billing is enabled). Prices, currency, and billing terms shown at checkout apply. Payments are processed by Stripe; we do not store full card numbers on Nightingual servers.
Specialty modules beyond General abbreviations and participation in award tournaments require an active paid Plus subscription, an active SFU school grant, or another access path shown in the product (for example admin accounts). General abbreviation learning may remain available to signed-in users without Plus, subject to product changes.
You may cancel or restore a Stripe subscription where the product UI allows. Cancelled paid access may continue until the end of the current paid period when Stripe reports cancel-at-period-end. Never-subscribed trial accounts do not have a paid subscription to cancel.
4. Tournaments and awards
Live tournaments may be published by Nightingual operators. Eligibility to join requires paid Plus or an active school grant as described above; the consumer free trial alone does not permit entry.
Each eligible student may join a tournament and complete one question round. The number of questions in a round is set by the operator for that tournament (commonly 50, and adjustable in the admin console).
Leaderboards may rank participants by XP, fewer mistakes, and earlier activity, and may show nickname and member ID only. Prize or award descriptions (if any) are promotional statements set for that tournament and are subject to the rules published with it. Nightingual may change, postpone, or cancel tournaments for operational or fairness reasons.
5. Referrals
Signed-in users may receive a personal referral code to share. Referral rewards apply only after the referrer has subscribed to paid Nightingual Plus (trial-only accounts are not eligible to receive the reward).
As described in the product, every 10 referred friends who remain on paid Plus for 12 consecutive months — or who subscribe annually without a refund — may unlock a HKD $78 reimbursement credited toward the referrer’s next Stripe invoice (or an equivalent credit path configured by the operator). Abuse of referrals (fake accounts, self-referral, or fraud) may void rewards and lead to account action.
6. Learning content and clinical safety
Vocabulary, abbreviations, lesson prompts, assessments, teaching materials, and topic modules are for pronunciation and comprehension practice. Spoken expansion of unsafe abbreviations (for example ISMP-listed forms such as U, IU, QD, QOD, MS) must not be written on clinical charts unless permitted by your organisation’s policy.
Pronunciation assessment may require microphone access in your browser. Skipping an assessment item may count as incorrect, as shown in the product. Always follow your school, hospital, or employer policies and licensed professional judgement. Nightingual does not verify clinical accuracy for a specific patient or care setting.
7. Acceptable use
You agree not to misuse Nightingual, including by attempting unauthorised access, disrupting the service, scraping or redistributing content at scale, uploading unlawful or harmful material, abusing tournaments, referrals, or feedback channels, or using the service for non-educational clinical documentation.
We may suspend or terminate accounts that violate these Terms or create risk to other users or the service.
8. Intellectual property
Nightingual branding, software, lesson structures, and curated content are owned by Nightingual or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the service for personal learning while your account remains in good standing.
You may not copy, sell, or publicly republish substantial portions of the vocabulary or assessment banks without prior written permission.
9. Privacy and data
We process account data (such as name, email, nickname, member number, learning progress, entitlement/subscription and referral metadata, voice-preference settings, and feedback you submit or receive) to operate Nightingual, authenticate you, run tournaments and referrals, send optional browser notifications you enable, and improve the service.
Payment details are handled by Stripe according to Stripe’s terms and privacy policy. Speech features may use browser speech APIs or optional third-party speech services when configured by the operator.
10. Availability and changes
We aim to keep Nightingual available but do not guarantee uninterrupted or error-free service. Features, pricing, trial rules, school grants, tournament settings, referral rules, and content may be updated from time to time.
We may update these Terms by posting a revised version on this page. Continued use after changes constitutes acceptance of the updated Terms, except where applicable law requires otherwise.
11. Disclaimers and liability
To the fullest extent permitted by law, Nightingual is provided “as is” without warranties of merchantability, fitness for a particular purpose, or non-infringement.
Nightingual and its operators are not liable for clinical decisions, examination outcomes, employment decisions, tournament or referral outcomes, or losses arising from reliance on pronunciation or terminology practice in Nightingual, except where liability cannot be excluded under applicable law.
12. Governing law
These Terms are governed by the laws of Hong Kong Special Administrative Region, without regard to conflict-of-law rules. Courts of Hong Kong have exclusive jurisdiction, subject to any non-waivable consumer protections that apply to you.
